These Terms of Service (the "Terms") govern your access to and use of Xitik (the "Service"), including the Xitik desktop application, the website at xitik.com, and any related APIs (collectively, the "Platform"). By creating an account, installing the application, or otherwise using the Service, you agree to be bound by these Terms.
If you do not agree, you must not use the Service.
Xitik is a desktop application that captures audio from publicly available, user-selected livestreams running on the same computer and produces real-time AI-generated subtitles in the language you choose. Xitik does not host, redistribute, record, or store the underlying livestreams. The Service is intended for personal, non-commercial use.
The Service is operated by Xitik, an independent software publisher. References in these Terms to "Xitik", "we", "us", or "our" mean the operator of the Xitik service. For any inquiries you can reach us at [email protected]; a postal address is available on written request to the same email.
The Service offers a free tier and paid subscription plans (currently Pro and VIP). Current pricing and features are listed on the Pricing page.
Merchant of Record. All paid Xitik subscriptions are sold and billed by Whop Inc., which acts as the Merchant of Record (MoR). Whop processes your payment, manages billing details, collects applicable taxes, handles fraud prevention and chargebacks, and is the legal seller for the transaction. Your bank or card statement will display "WHOP* XITIK" (or a similar Whop-prefixed descriptor) as the merchant. Whop's checkout terms also apply to your purchase and can be reviewed at whop.com/terms.
Refunds are governed by our Refund Policy, which forms part of these Terms. In short, 7-day refund available if the service does not meet expectations, within the time and usage rules described in that policy.

Xitik produces subtitles for content that you choose to play on your own device. The original livestream is hosted by third-party platforms (e.g. Douyin, Kuaishou, Bilibili). Xitik is not affiliated with those platforms, does not redistribute their content, and is not responsible for their content, availability, or terms. You are responsible for complying with the terms of any third-party platform you use.
All rights in the Xitik Platform, including the desktop application, website, branding and content (excluding AI-generated subtitles produced for your personal use), are owned by Xitik or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes, in accordance with these Terms. AI-generated subtitle output produced by the Service for your personal use is yours to keep, subject to the rights of the original livestream owner.
Subtitles are produced by automated speech-recognition and machine-translation models (currently powered by Groq Whisper-Large-v3-Turbo and OpenAI GPT-4o-mini). Output may contain errors, omissions, mistranslations or outdated information. Subtitles are provided "as is" for entertainment and convenience and must not be relied upon for medical, legal, financial, safety-critical or other consequential decisions.
Our processing of personal data is described in our Privacy Policy. By using the Service you consent to that processing.
We may suspend or terminate your account, with or without notice, if (i) you breach these Terms, (ii) we are required to do so by law, or (iii) we discontinue the Service. On termination your access ends. Refunds for paid subscriptions remain governed by our Refund Policy.
You may terminate your account at any time by deleting it from the application or by emailing [email protected].
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, including any warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation, to the maximum extent permitted by applicable law.
To the maximum extent permitted by applicable law, Xitik's aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the total amount you paid for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) USD 50. In no event will Xitik be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, including lost profits, lost data or business interruption, even if advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be excluded under applicable law (including liability for fraud, gross negligence or wilful misconduct).
You agree to indemnify and hold harmless Xitik and its operators, employees, agents and licensors from and against any claims, damages, losses and expenses (including reasonable legal fees) arising out of (i) your use of the Service, (ii) your breach of these Terms, or (iii) your violation of any law or third-party right.
We may update these Terms from time to time. If we make material changes we will notify you by email or through the Service with reasonable advance notice before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict-of-laws rules. The state and federal courts of competent jurisdiction located in Delaware will have non-exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except that either party may seek injunctive relief in any competent court to protect its intellectual-property rights. Billing-related disputes are additionally subject to the dispute-resolution terms of Whop Inc., which acts as the Merchant of Record for paid subscriptions. Nothing in this section affects mandatory consumer-protection rights you may have in your country of residence.
